Welcome to Your Uncle Phil. These Terms of Service (“Terms”) govern your use of the Your Uncle Phil website and subscription service operated by TD Gorilla LLC (“we,” “us,” “our”), a Missouri limited liability company. By subscribing to or using our service, you (“subscriber,” “you,” “your”) agree to be bound by these Terms. If you do not agree, please do not subscribe or use the service.

1. Description of Service

Your Uncle Phil is a monthly physical letter subscription service. Each month, we write, print, and mail a letter to active subscribers at the U.S. mailing address provided during checkout. Each letter contains original written content including stories, life advice, commentary, and supplementary materials such as insert cards. The content of each letter is determined solely by us and may vary from month to month.We also maintain a website and email list hosted on the Beehiiv platform for the purpose of communicating with subscribers about their subscription, sharing updates, and providing related content.

2. Eligibility

You must be at least 18 years of age and reside in the United States to subscribe. By subscribing, you represent that you meet these requirements. We currently ship only to U.S. addresses.

3. Subscription and Billing

3.1 Pricing. The subscription fee is $12.00 USD per month. Prices are subject to change with 30 days’ written notice to active subscribers via email.

3.2 Payment Processing. All payments are processed through Stripe, Inc. By subscribing, you agree to Stripe’s terms of service (https://stripe.com/legal). We do not store your credit card number or payment credentials on our servers.

3.3 Billing Cycle. Your subscription billing cycle begins on the date you subscribe and recurs monthly on the same date. Your first payment of $12.00 is charged immediately upon subscribing. Subsequent charges of $12.00 occur automatically each month on your billing anniversary date.

3.4 Failed Payments. If your payment fails, Stripe will automatically retry the charge according to its standard retry schedule (typically up to 3 attempts over approximately one week). If all retry attempts fail, your subscription may be paused or canceled, and you will not receive a letter for that month. We are not obligated to provide letters for months in which payment was not successfully collected.

3.5 No Refunds for Current Billing Period. Subscription fees are non-refundable for the current billing period. If you cancel your subscription, you will continue to receive service through the end of your current paid billing period, but no partial refund will be issued.

4. Cancellation

4.1 How to Cancel. You may cancel your subscription at any time by: (a) using the Stripe customer portal link provided in your welcome email or account communications, or (b) emailing us at [EMAIL]. Cancellation requests are processed within 2 business days.

4.2 Effect of Cancellation. Upon cancellation, your subscription remains active through the end of your current billing period. You will receive any letter scheduled to ship during that period. No further charges will be made after the current period ends.

4.3 Resubscription. If you cancel and later wish to resubscribe, you may do so at the then-current subscription price. A new initial payment will be required.

5. Shipping and Delivery

5.1 Shipping Method. All letters are shipped via United States Postal Service (USPS) First-Class Mail. Letters are mailed during the third week of each month (approximately the 18th–22nd).

5.2 No Tracking. Letters are mailed with standard postage and do not include tracking numbers. This is intentional and consistent with the personal nature of the service.

5.3 Delivery Timeframe. USPS First-Class Mail typically delivers within 1–5 business days from the mailing date. We cannot guarantee specific delivery dates, as delivery is handled entirely by USPS.

5.4 Non-Delivery. If your letter has not arrived within 14 calendar days of the estimated mailing date, please contact us at [EMAIL]. We will resend your letter at no additional charge, limited to one replacement per month. We are not responsible for mail lost, stolen, or damaged by USPS after it leaves our possession.

5.5 Address Accuracy. You are responsible for providing a complete and accurate mailing address during checkout. If a letter is returned to us due to an incorrect or incomplete address, we will attempt to contact you for a corrected address and resend the letter. Repeated returns due to address issues may result in pausing your subscription until the address is corrected.

5.6 Address Changes. To update your mailing address, email us at [EMAIL] at least 5 days before the next scheduled mailing date. We cannot redirect letters that have already been mailed.

6. Welcome Package

New subscribers receive a one-time welcome package that includes a welcome letter, a membership card, and supplementary materials. The welcome package is mailed separately from the monthly letter, typically within 3–5 business days of your first payment being processed. The contents of the welcome package may change over time at our discretion.

7. Intellectual Property and Content Ownership

7.1 Ownership. All content included in Your Uncle Phil letters and welcome packages — including but not limited to written text, stories, advice, commentary, illustrations, photographs, insert cards, and any other materials — is the original creative work of Your Uncle Phil and TD Gorilla LLC. All content is protected by United States copyright law and international copyright treaties.

7.2 Limited License. By subscribing, you receive a personal, non-exclusive, non-transferable, revocable license to read and privately enjoy the physical letter and materials you receive. This license does not grant you any ownership rights in the content.

7.3 Prohibited Uses. You may NOT, without our prior written consent:

  • Reproduce, copy, scan, photograph, or digitize the letter content in whole or in substantial part.

  • Post, upload, share, distribute, or publish letter content on any website, social media platform, blog, forum, podcast, video, or any other digital or physical medium, whether publicly or within private groups.

  • Excerpt, quote, or paraphrase substantial portions of letter content in any public or semi-public context.

  • Resell, sublicense, redistribute, or commercially exploit any letter content.

  • Use letter content to create derivative works.

7.4 Permitted Sharing. You ARE permitted and encouraged to:

  • Share photos of the sealed envelope or the physical letter without legible text visible (for social media, etc.).

  • Discuss the general themes, topics, or subjects of letters in conversation or on social media (e.g., “This month Uncle Phil wrote about starting over after a career change”).

  • Recommend the subscription to others.

7.5 Enforcement. If we discover that letter content has been reproduced, shared, or distributed in violation of this Section 7, we reserve the right to: (a) issue a Digital Millennium Copyright Act (DMCA) takedown notice to the hosting platform; (b) terminate your subscription immediately without refund; and (c) pursue additional legal remedies available under applicable law, including but not limited to claims for copyright infringement and injunctive relief.

8. Gift Subscriptions

8.1 Purchasing a Gift. You may purchase a subscription as a gift for another person by entering the recipient’s shipping address during checkout. The purchaser is responsible for providing an accurate recipient address.

8.2 Gift Recipient’s Obligations. The gift recipient is bound by these Terms of Service with respect to the content they receive, including all intellectual property restrictions in Section 7.

8.3 Refund Policy for Gifts. Gift subscriptions are non-refundable after the first letter or welcome package has been mailed.

9. Disclaimer of Professional Advice

The content in Your Uncle Phil letters represents the personal opinions, life experiences, and general commentary of the author. It is NOT professional advice of any kind, including but not limited to financial, legal, medical, psychological, therapeutic, tax, or career advice. You should consult qualified, licensed professionals for specific guidance in these areas. We disclaim any responsibility for decisions or actions you take based on letter content.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TD GORILLA LLC AND ITS OWNER, MEMBERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR THE CONTENT OF ANY LETTER, REGARDLESS OF THE THEORY OF LIABILITY.OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE TOTAL SUBSCRIPTION FEES ACTUALLY PAID BY YOU TO US IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless TD Gorilla LLC and its owner, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your violation of these Terms; (b) your misuse of letter content in violation of Section 7; or (c) any third-party claim arising from your actions related to the service.

12. Modifications to Terms

We may update these Terms from time to time. If we make material changes, we will notify active subscribers via email at least 30 days before the changes take effect. Your continued subscription after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you may cancel your subscription before the effective date.

13. Termination by Us

We reserve the right to terminate your subscription at any time, with or without cause, by providing you with written notice via email. If we terminate your subscription without cause, we will refund any prepaid fees for the period following the termination date. If we terminate your subscription due to your violation of these Terms (including but not limited to unauthorized distribution of content), no refund will be provided.

14. Governing Law and Dispute Resolution

14.1 Governing Law. These Terms are governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict of laws principles.

14.2 Dispute Resolution. Any dispute arising out of or related to these Terms or the service shall first be submitted to good-faith mediation. If mediation is unsuccessful, the dispute shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration shall take place in Greene County, Missouri. Each party shall bear its own costs of arbitration.

14.3 Class Action Waiver. You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TD Gorilla LLC regarding the Your Uncle Phil subscription service, and supersede all prior agreements, understandings, and communications, whether written or oral.

4.2 Payment Data. We do not store your credit card number or full payment credentials. All payment data is collected, processed, and stored by Stripe, which is PCI-DSS Level 1 compliant (the highest level of payment security certification).
